Danville Council Upholds Approval of CPC Mixed-Use Development Amidst Neighbor Concerns and State Law Limitations

The Danville Town Council reviewed an appeal regarding a mixed-use housing development proposed by Community Presbyterian Church (CPC) at 222 West El Pintado Road. The project includes 68 residential units (49 townhomes and 19 ADUs), a new 27,000 sq ft youth ministry building, a pavilion, soccer field, and basketball courts. The Planning Commission had unanimously approved the project, but it was appealed by nearby neighbors concerned about traffic, noise, infrastructure, and neighborhood character. State housing laws, including the density bonus law and CEQA exemptions, significantly limit the town's ability to deny or modify such projects. The council ultimately voted 3-1 to deny the appeal and uphold the Planning Commission's approval, with several conditions of approval, including sending specific design modifications for the youth ministry building to the Design Review Board (DRB) for further review, ensuring the soccer field remains private and unlit, and clarifying that existing utility lines will be undergrounded for new construction, while undergrounding existing overhead lines along Ilo Lane is a concession that cannot be denied without a health/safety finding. Concerns about the youth ministry building's location, size, and proximity to the street were significant, leading to a condition for DRB to study moving it further east or flipping it 180 degrees. The council also noted limitations on reducing the housing unit count due to state mandates and the town's housing element obligations.
