Planning Commission Approves Variance for Second Driveway on Spanish Oak Drive
The Planning Commission considered a variance request (V-26-06) for a second curb cut and driveway at 3939 Spanish Oak Drive. The applicant, represented by Nicole Reynoldso Coyado, sought to address issues with the existing steep driveway, which caused safety concerns, particularly during rain and snow. Staff initially recommended denial due to the proposed structure being in the city's right-of-way and partially on a drainage easement. However, after the applicant revised their site plan and addressed court-ordered requirements to remove an unpermitted concrete pad, staff presented two options: Option A, expanding the existing driveway (requiring justification of hardship if not feasible), and Option B, approving the proposed second driveway with the condition that the existing concrete pad and structure be removed. The applicant expressed a preference for Option B due to topographical concerns with Option A potentially directing water towards the house. The Commission ultimately voted to approve Option B, recommending the new driveway location and the removal of the existing structure, with the decision to proceed to the City Council for final review on June 17th.
