This amendment complies with Florida Statute SB954, requiring local governments to provide a process for these residences to seek accommodation from existing codes, such as zoning restrictions and distance requirements. Currently, there are no identified certified recovery residences in Akoi, and the city does not have specific ordinances regulating them beyond requiring a business tax receipt. The Planning and Zoning Commission recommended approval with a 5-0 vote. During the discussion, a question was raised about potentially adding a distance restriction, similar to those for group homes, to which staff noted that such a restriction could be introduced via a future amendment. The commission ultimately approved the amendment with a condition that staff bring back a similar restriction for certified recovery residences as applied to group homes, referencing a thousand-foot rule.
