City to Convey Property Back to Hutchinson Entertainment Project LLC After IRB Payoff
The council considered and approved a resolution authorizing the sale and conveyance of property back to Hutchinson Entertainment Project LLC. This property was originally owned by the city due to the issuance of taxable industrial revenue bonds (IRBs) in 2014, totaling $6.5 million, for the construction of a bowling alley and entertainment center. With the IRBs now paid in full by the LLC, the city is deeding the property back. This action will return the business to the tax rolls, making it responsible for property taxes again. The bowling alley is located at 1221 East 23rd.
Hutchinson Proclaims August 1st, 2026, as Emancipation Day
The council proclaimed August 1st, 2026, as Emancipation Day in Hutchinson, recognizing the historical significance of Emancipation Celebration in the community, which has been maintained for over 135 years. The proclamation highlighted the ongoing struggle for true freedom and equality. Events celebrating Emancipation Day were announced, including a three-point shootout at the new YMCA, a jazz evening, a parade, a community picnic with food trucks, and an old-school dance. The proclamation was presented by Mayor Scott Meers.
City Council Authorizes Notice of Breach for Plum Creek Development Over Contractual Failures
The city council discussed the challenges and contractual breaches associated with the Plum Creek subdivision development. City staff presented evidence of the developer, Jim Strawn, failing to meet contractual obligations, including missed deadlines for home construction, outstanding tax payments totaling $317,000, and the non-fulfillment of promised amenities like a neighborhood pool and duplexes. The city is requesting authorization for the city manager to issue notices of breach of contract under the RHID development agreement and the MIH developer agreement. These notices initiate a formal process for addressing the defaults, with a 14-day cure period for beginning a remedy and 30 days to complete it. The city has provided significant financial support and waivers to the developer, totaling approximately $1.71 million in temporary notes and waived fees. The developer has also received state tax credits and has a history of delinquent taxes on other properties. The council ultimately voted to authorize the city manager to prepare and send these notices of breach and right to cure.
Storm Water Utility Repealed as City Approves New Sales Tax
The council considered an ordinance to repeal sections of the city code related to the storm water utility, effective October 1st, coinciding with the implementation of a new 75% sales tax. City Attorney Paul Brown stated this fulfills a promise to citizens. A question arose regarding the remaining balance in the storm water retention fund, which is approximately $7 million. Bruce Miller inquired about the utilization of these funds, suggesting they could be used for storm water infrastructure issues in specific areas. The council confirmed the funds will be used for storm water infrastructure, a legal use for those funds. The ordinance was approved.
Councilmember Garza Expresses Disappointment with Community Meeting Attendance, Commends Staff
Councilmember Steve Garza expressed disappointment with declining attendance at his bimonthly community meetings, despite providing coffee and a venue. He thanked city staff who volunteer their time to attend these meetings. He also commended the City Manager and staff for their work on projects like the wastewater treatment plant and the Plum Creek development, expressing pride in their efforts to improve the city. Councilmember Garza also noted his fatigue from his work and acknowledged potential disorganization due to it.
